Understanding the 3 types of Buyer Representation
**Pre-Agency**
Pre-agency is the period before you decide whether to be a client or a customer. During this time, I, as your agent, act as a neutral provider of information and do not represent either party. We can attend showings together, but I cannot engage in any negotiations, such as drafting an offer. If I am showing you a home during pre-agency, we will need a written agreement. Once you are ready to negotiate, you will need to choose whether to be a customer or a client, which ends the pre-agency phase. Remember, during pre-agency, I cannot negotiate or write offers for you.
**Customer**
If you decide to be a customer, I will provide you with a Disclosure to Customers form. As a customer, I can draft offers for you but cannot offer opinions or advice that could conflict with the seller’s interests. In this scenario, my firm acts as a subagent of the listing firm. If we have already completed the Disclosure to Customers form, no additional written agreement is needed when showing homes.
**Client**
If you choose to become a client, we will enter into a WB Buyer Agency Agreement, allowing me to fully represent your interests. As your agent, I can provide a comprehensive range of services to ensure your best interests are prioritized:
- Offer a candid opinion or critique of a seller’s property beyond just disclosing defects.
- Recommend or suggest an offering price and provide an opinion on whether a particular house is priced too high or too low.
- Structure the offer and draft offer provisions with your best interests in mind.
- Recommend and assist you with negotiation strategies to secure the best price and most favorable terms.
- Research and disclose information about a property’s history, title, and liens to help you make a well-informed decision.
- Conduct optional investigations and research tailored to your specific needs, which may vary from agent to agent.
- Provide information and advice within my expertise as a licensed real estate agent.
This agreement ensures that you receive dedicated support and expert guidance throughout your home-buying journey.
